Terms of Service
Welcome to the Asiasoft Passport, PlayPark and PlayMall associated websites (Asiasoft Passport, Playpark, and Playmall each are referred to as a “Site” and collectively the “Sites“).
Please read the terms and conditions carefully before using Sites or any services associated to these Sites. Sites are owned and operated by Asphere Innovations Public Company Limited. (hereinafter referred to as “Asphere Innovations“). “User or Users” are the person or entity using the Sites.
The terms and conditions of use shown here (hereinafter referred to as the “Terms and Conditions“) set forth the terms between Asphere Innovations and Users. User must read carefully and understand all Terms and Conditions before entering the Sites.
By using these Sites, or using associated services, or by registering the Asiasoft Passport or PlayID (hereinafter referred to as “Account ID“), User agrees to accept the Terms and Conditions. If User does not agree to these Terms and Conditions, User does not have permission to use the Sites and/or Account ID.
Asphere reserves the rights to change, edit, add, or remove part of Terms and Conditions without prior announcement. If any future changes to these Terms and Conditions are unacceptable to User, User may discontinue the use of the Sites and/or Account ID immediately without any dispute.
These Terms and Conditions are for Sites including but not limited to related Sites, print media, online documents and/or electronic documents, and other sources. User accepts the Terms and Conditions specified as follows below.
1. Objective
▪ The Terms and Conditions shall specify the User’s rights and obligations, which the User must read carefully to understand before entering the Sites, and /or the game(s). The User shall use the Sites privately and not for business and/or other purposes.
2. Legally Binding
▪ Upon accepting the Terms and Conditions, User shall be legally bound with the Terms and Conditions, as well as other User terms and/or related laws and regulations. User who does not accept the Terms and Conditions shall not have rights to use Sites. Asphere Innovations reserves the right to amend the Terms and Conditions at any time without prior notice to User, and User shall not have the right to claim any loss or damage from Asphere Innovations. User shall be solely responsible for any civil and/or criminal liability, tort, which may occur. User is advised to regularly check for amendments from the official Sites www.playpark.com and www.playmall.com.
3. Personal Information
▪ User agrees to provide his or her personal information (including but not limited to name, surname, and related information) for registration purposes. In case of changing any personal information, User must inform such changes to Asphere Innovations immediately. If any User account information is found to be incorrect, Asphere Innovations reserves the right to terminate the User’s membership account from all Asphere Innovations services immediately without any right of claim from the User. To protect User’s rights, Privacy Policy has been introduced in the Sites in compliance with international data protection laws. User must read and understand the Privacy Policy to protect his or her rights. User agrees to transfer all registered information to Asphere Innovations, who may use User’s personal information for evaluation and business record purposes.
4. Amendment
▪ Asphere Innovations reserves the right to amend the Terms and Conditions to comply with changes in laws, regulations and policies from time to time. Any amendments shall be posted in the official Sites www.playpark.com and www.playmall.com.
5. User’s Rights
▪ User reserves the right to use the Sites service as specified below. Asphere Innovations reserves the right to terminate any User who breaches any clause under these Terms and Conditions without prior notice to the User.
5.1 User has the right to enter into and use the Sites [www.playpark.com and www.playmall.com].
5.2 User can use Sites for personal use only. Infringement of any rights and/or Intellectual Property rights in the Sites and/or program without permission from Licensor or Asphere Innovations is strictly prohibited.
5.3 User must not reverse engineer Sites and/or programme.
5.4 User can use Sites only from the channel provided by Asphere Innovations. However, the following actions listed below are illegal and prohibited.
5.4.1 To attack Sites or break any channel connecting to Sites servers.
5.4.2 To disturb, threaten, follow, block, or trouble other User(s) on the Sites including but not limited to cheating or taking advantage of other User(s) and/or Asphere Innovations in any way.
5.4.3 To send or announce any message or other communication methods, which is illegal or inappropriate, including implicating politics, race, or religion, etc.
5.4.4 To disturb the normal communication in Games and/or Sites
5.4.5 To spread advertisements, rumours and chain letters.
5.4.6 To connect to the Games server and/or Sites with other methods that are not normal.
5.5 User agrees and confirms that User shall not delete, destroy, and cover up any trade mark, trade name, copyright mark, and other mark of the Licensor and/or Asphere Innovations.
5.6 User has read and understood the Terms and Conditions of Sites. User agrees that Asphere Innovations reserves the right to terminate User’s account with its sole discretion and not to claim for any losses against Asphere Innovations.
5.7 User agrees and understands that “Points” specified in Sites and/or services cannot be redeemed.
5.8 User agrees and understands that if the User’s Site account has not been used by User for more than one (1) year (12 months), Asphere Innovations, in its sole discretion, reserves the right to confiscate the Points from the relevant User’s account or terminate the account.
5.9 User agrees and understands that “Points” in Sites and/or program is the sole property of Asphere Innovations whenever User transfers money into Sites to purchase Points. Points shall be used for trading with in-game items or services. User agrees not to use Points for business or other purposes except the purpose specified in this clause. In the event of missing Points, User shall report to the police and provide the police report document to Asphere Innovations for investigation. Thereafter, Asphere Innovations will investigate and report back to the police investigation officer. If User reports false information intentionally to the police, Asphere Innovations reserves the right to take legal action against such User.
6. Confidentiality
▪User agrees and accepts that all data and information obtained by User from using Sites are confidential. Disclosing such data and information publicly is strictly prohibited.
7. Account ID and Password
7.1 User agrees to provide true, accurate and complete information about him or herself, as prompted by the Account ID registration process. Asphere Innovations reserves all rights to revoke any Account ID that is found registered with untrue information; and User agrees to accept any damages that may occur from untrue or other personal information, and will not request for any indemnification from Asphere Innovations. Any information that User registered with Asphere Innovations and/or any service information belongs to Asphere Innovations; and User agrees to allow Asphere Innovations to reveal User’s information and/or service information to government agencies (Eg. the police) upon receiving any requests by such agencies.
7.2 User agrees and accepts that any information that Asphere Innovations marks as important will not be able to be changed, modified, or removed after registration, unless by special written request from the User.
7.3 To contact Asphere Innovations’s Support Centre, User only requires his or her Account ID for identification. Asphere Innovations’s Support Centre shall never ask for User’s Password. User shall keep his or her Account ID Password as confidential information known only to him or herself. User agrees not to provide his or her Account ID and Password to any other person. In any case of negligence by User, Asphere Innovations reserves the right not to indemnify any loss of Account ID, Password, and/or Point to the relevant User.
7.4 For the data protection and information safety of the Account ID User, User needs to keep his or her ID and Password in a safe and secure manner without informing any other person. User agrees that if ID and/or Password have been lost or stolen by any other person, it is the sole responsibility of User, as Asphere Innovations has already used adequate methods of security to prevent such incidents. User agrees to accept such damages (including but not limited to damage from stolen and fraudulently traded items) at all costs and will not request for any indemnification from Asphere Innovations.
7.5 Giving Account ID and/or Password information to any other person is strictly prohibited, including co-using/sharing and selling User’s Account ID to any other person.
7.6 Any registration of online games under Asphere Innovations’s Account ID service is covered by these Terms and Conditions.
7.7 Any game agreement under User’s Account ID service is part of these Terms and Conditions. If there is any contrast between the game agreement and these Terms and Conditions, the subject in these Terms and Conditions will prevail and be in effect.
7.8 In cases that User has been blocked from any servicing game or any game ID under his or her Account ID service, both permanently or non-permanently, User will not request for any indemnification from any virtual item value that User has been charged for, and/or any damage from not being able to access any item/ID that has been blocked and any valuable that can be traded from items.
7.9 In the event that the relevant law agency, the various departments of the state, government officers, and/or the court determine that Asphere Innovations is required to disclose information of User’s Account ID, User agrees and consents for Asphere Innovations to disclose such information, and to not claim from Asphere Innovations any damages that may subsequently arise.
8. Force Majeure
8.1 Asphere Innovations shall not be responsible for any damage caused by Force Majeure.
8.2 Asphere Innovations shall use best possible efforts to provide proper Sites service to User. User understands that there are risks for using the Service, and User agrees to bear such risk by him or herself without any rights to claim, sue, and/or take legal action against Asphere Innovations. Asphere Innovations reserves the right, by its own discretion, to consider indemnifying User for his or her loss.
8.3 “Points” shall be used only for Asphere Innovations’s Online Games and Services, such as Sites. Asphere Innovations shall not be responsible to User if User uses Points for other purposes.
8.4 User acknowledges that “Points” in Sites cannot be transferred to other User. Any loss or damage arising from trying to transfer “Points” is not Asphere Innovations’s responsibility.
8.5 In case of loss or damage arising from using Sites service, Asphere Innovations reserves the right to consider whether to indemnify User or not.
9. Obligation and Responsibility
9.1 User must accept the Terms and Conditions before using Sites. If User does not accept the Terms and Conditions, User agrees not to use the Sites and/or any Asphere Innovations’s service provided in the Sites or Programme. User under 18 years of age or yet to reach the legal age, must obtain permission from his or her parent and/or guardian when registering in the Sites or any Programme under Asphere Innovations’s services. The parent and/or guardian must read and accept the Terms and Conditions, and take full responsibility together with their minor User.
9.2 User agrees to comply with all relevant laws, including international internet laws and/or any related country’s laws.
10. Termination
10.1 Asphere Innovations reserves the right to terminate any User’s Account ID without prior notice, if Asphere Innovations, in its sole discretion, considers that the relevant User does not comply with these Terms and Conditions.
10.2 User accepts and agrees that registered PlayID and items are properties of Asphere Innovations that User receive from playing, in-game trading, events and activities both in and out of the game, items traded from any cash card; are only the rights to use those things within a specific period, and not ownership of those things by User. User agrees to let Asphere Innovations revoke and/or block access to those items and/or Account ID without any objection.
10.3 User cannot use granted service against any other person’s privacy, including against any law, tradition or moral. In case there is any damage incurred, User agrees to allow Asphere Innovations to revoke access to his or her Account ID; User will also not be able to access any game that is under the relevant Account ID service. User agrees to accept all costs caused by damage of his or her own, and will not request for any indemnification from Asphere Innovations.
10.4 User agrees to accept and follow Service Provider’s rules, directions, and ethics. If Asphere Innovations finds any violation in rules, directions or ethics, User agrees to allow Asphere Innovations to cease User’s Account ID and/or any service under PlayID without prior notice to User.
10.5 Asphere Innovations reserves all rights to block or revoke any Account ID any time without prior notice to User. In the event that any User has not logged into his or her Account ID service or any game under Account ID service for more than one (1) year (12 months), Asphere Innovations reserves all rights to revoke User’s Account ID without prior notice to User.
10.6 User accepts and agrees to allow Asphere Innovations temporary revoke Account ID that is under investigation for any violation of cash card usage and/or game rule until such investigation finishes.
11. Amendment
▪Asphere Innovations reserves the right to amend, modify, change, add or terminate the Terms and Conditions at any time in its sole discretion. Asphere Innovations has all rights to edit, change any, or all of the license agreement, or revoke the service without prior notice to User.
12. Ceasing of Service
▪In any event that Asphere Innovations cannot provide Sites service, Asphere Innovations reserves the right to cease Sites service. Asphere Innovations shall inform User by posting a notice with the end date on the Sites before ceasing service. User shall have no rights to loss claim from Asphere Innovations for the ceased Sites service.
13. Terms of Sale for Onlines Games & Services
▪ By placing an order on the Sites, User agrees to submit a binding offer to purchase digital content, such as Online Games and Services from Asphere Innovations. Based upon User’s billing address, Asphere Innovations will collect sales tax on User’s behalf and remit payment to the local government where digital goods are taxable. User’s orders are accepted and a contract concluded once Asphere Innovations have sent User a Confirmation Email. User hereby expressly agrees that the supply of Online Games and Services begins immediately after the Confirmation Email is sent. All sales for Asphere Innovations’s Online Games and Services are final and no refunds are permitted, except with respect to any statutory warranties or guaranties that cannot be excluded or limited by law.
*User has read and understood the Terms and Conditions and/or any amendment from time to time, and complies with the Terms and Conditions set forth hereunder.
